In 2022, Maryland enacted a statewide Paid Family and Medical Leave Insurance (FAMLI) program designed to provide workers with paid time off for caregiving, medical needs, and family leave. In 2025, state lawmakers delayed the start of benefit payments to complete operational setup, pushing the timeline for when workers can use the program to 2028.
Importantly, the delay does not repeal or weaken the underlying law. The program’s structure and legislative authority remain intact, reflecting a continued long-term commitment to paid family and medical leave—even as access has been postponed.
Paid family and medical leave affects whether people can take time off to care for a new child, recover from illness, or support a loved one without risking their income or job.
The delay prolongs existing benefit gaps for Maryland workers—particularly for women, who are more likely to take on caregiving responsibilities.
Maryland created its Paid Family and Medical Leave Insurance program through the Time to Care Act of 2022, establishing the structure, funding mechanism, and administrative authority for a statewide paid leave system. Like similar programs in other states, FAMLI was designed to roll out over several years rather than take effect immediately.
Between 2022 and 2024, the state focused on building the systems needed to operate the program, including developing regulations, setting up payroll contribution processes, and preparing administrative infrastructure within the Maryland Department of Labor.
In 2025, the General Assembly passed legislation delaying the start of benefit payments, citing the need for additional time to complete system development and ensure the program could operate sustainably. While contributions and administrative work continue, workers will not be able to access paid leave benefits until the revised 2028 start date.
