Supporters of a proposed reproductive rights ballot initiative submitted signatures in May 2026 in an effort to place the measure on Idaho’s November ballot. State officials are now verifying whether the campaign collected enough valid signatures to qualify.
If approved for the ballot, Idaho voters could directly decide whether to replace the state's current near-total abortion ban with broader reproductive-rights protections. Because lawmakers have not moved to expand abortion access through legislation, the initiative process has become one of the few remaining paths for voters to pursue policy changes.
What's at Stake
If the initiative qualifies, Idaho voters will decide whether to establish broader reproductive rights protections in state law, including protections related to abortion, contraception, fertility treatment, miscarriage care, and prenatal and postpartum care.
Supporters say the measure would restore reproductive healthcare protections that existed before the Dobbs decision, while opponents argue the proposal would significantly expand abortion access and could affect broader healthcare policies.
Ballot qualification process
County officials are expected to complete signature verification by the end of June 2026. If enough valid signatures are confirmed, the initiative will appear on the November ballot.
Potential ballot measure (November 3, 2026)
Reproductive Freedom and Privacy Act: If the initiative qualifies, Idaho voters will decide whether to establish statutory protections for reproductive freedom, including abortion, contraception, fertility treatment, miscarriage care, and prenatal and postpartum care.
