This November, voters will decide three major constitutional questions involving reproductive freedom, marriage equality, and voting rights. The reproductive freedom amendment [continues to face legal challenges](https://virginiamercury.com/2026/07/03/virginias-reproductive-rights-amendment-faces-legal-challenges-over-procedural-step-language/?ref=womensrightsdata.org) involving the amendment process and ballot language. Meanwhile, an [August federal court ruling](https://www.acluva.org/press-releases/federal-judge-rules-virginia-may-no-longer-deny-registration-for-hundreds-of-thousands-of-disenfranchised-voters/?ref=womensrightsdata.org) expanded voting eligibility for many Virginians with felony convictions, adding new context to the proposed constitutional amendment on voting-rights restoration. It would also prohibit the state from penalizing someone for receiving or helping with care related to pregnancy outcomes, including abortion, miscarriage, or stillbirth. - **A YES vote** would add these protections to the state constitution. - **A NO vote** would leave current laws in place without constitutional protection. Because this proposal would amend the state constitution, it would make these protections more durable and harder to change through future legislation. ### Redistricting and political representation In April 2026, Virginia voters approved a constitutional amendment that would have allowed the General Assembly to redraw the state's congressional districts before the 2026 election. The Virginia Supreme Court later invalidated the amendment, ruling that lawmakers had not followed the constitutional process required to place it before voters. The U.S. Supreme Court declined to intervene in May, ending the effort to use new congressional districts for the midterms.
