# Nebraska - What to watch in 2026

**As of September**, Nebraska voters will decide on a proposed constitutional amendment that would [establish sex-based requirements for participation in school and college athletics](https://nebraskaexaminer.com/2026/08/28/sex-based-constitutional-restriction-on-nebraska-k-12-collegiate-sports-qualifies-for-ballot/?utm%5Fsource=chatgpt.com). A separate proposed amendment defining personhood as beginning at fertilization [did not qualify](https://ballotpedia.org/Nebraska%5FEstablish%5FPersonhood%5Fof%5FPreborn%5FChildren%5FAmendment%5F%282026%29?ref=womensrightsdata.org) for the November ballot.

### What's at Stake

**Sex Requirement for School and College Sports Amendment**  
This amendment would require schools to designate athletic teams as male, female, or co-ed based on biological sex and prohibit male participation on female-designated teams.

The requirements would apply to public K-12 schools and colleges, as well as certain private-school teams that compete against public schools.

Supporters say the amendment would preserve sex-based athletic opportunities for women and girls, while critics argue it could negatively affect transgender students.

**Note:** Nebraska already has a state law requiring students to participate on teams designated for their sex. This amendment would place sex-based athletic requirements in the state constitution, making them more difficult to change through future legislation.
